Hakk sod patra

I have to ask one query to forum. Member "A" having 1 wife "B", 1 Son "C" and 2 Daughters "D""E".

"A" died in yr 1994. After that on same yr "D" and "E" has been given hakk sod patra in name of "B" and "C".

In yr 2007 "B" died. Now "D" and "E" claiming property in name of their Father as well as Mother.

They have filed a Suite on JFMC Court. I want to know what will be result of such case ? Or should i go for Out of Court settlement ?

If it is registered relinquishment deed then their claim may not have any merits.


Local lawyer well versed with revenue/family/property/civil matter, that has examined all documents on record can advise the best.

Yes, relinquishment deed is registered in Sub Registrar office in yr 1994. But i consulted with one of lawyer in Pune he said that 2 legal heirs are there i.e. "B" and "C". So property gets divided in 2 pieces.

But now in 2007 "B" died. Now "D" and "E" claiming property in name of "B".

As per laywer that 1/2 property will get divided in 3 pieces i.e 1/3 share to "C" , "D" ands "E" resp.

Is that so?

Yes, "C""D" & "E" are children of "B"

What will be result in such case or shall i go for out of court settlement.

The daughters are eligible for share in property/share from share of mother.
