Harassment by standard chartered bank and the cibil

(Querist) 01 December 2012 This query is : Resolved
Dear Experts,

One of my friends closed his credit card with SCB in Oct’2004. After keeping silence of 8 years, they registered an overdue amount of Rs 62709.11 with CIBIL. This amount was never reported in the past to CIBIL. This amount is totally againt interest, late payment charge , etc. which added upon added over 8 years. When filed dispute with CIBIL, they simply said, they are referring the matter to SCB and can’t alter any status without the consent of member bank. He sent an email to CIBIL as quoted below:

"Dear Sir,

This is very embarrassing for me to receive the reply like this from you. You are maintaining certain information about me to which I have no say but your member bank have every say and can give any wrong input for me like in the present case they reported some overdue after 8 years or so which is even time barred in the eyes of law and which is not informed or reported at any time in the past.
How can you entertain any overdue which is never reported in the past by your member bank SCB.
By following one sided say, you are allowing your member bank to use CIBIL as platform to extort money from us.
It also seems that you are not following or maintaining any code of conduct, rules, ethics, etc. for your member bank. This is something "Jab Saiya Bhai Kotwal Phir Dar Kaye Ka". This is totally against law of natural justice.
You can not escape just by saying that I am maintaining just the information received from member bank."

Please look in to that and save him from being harassed by such wrong hands. Plz advice the appropriate action to be taken.

Regards,

You are silent whether amount was actually due.

claim of bank seems to be barred by limitation . since bank has not filed any suit nor have you made any part payments or acknowledged your liablity bank wont be able to recover any money from you .

Dear Experts,

The credit card statement of an overdue amount was never sent by the Bank. When he approached another Bank for applying new Loan then he got to know this fact that there was an overdue to the tune of Rs. 2,000 which was never reported to by the Bank.

Not only this ,the Bank wrote a mail mentioning "On date, your card reflects an outstanding of Rs. 66,779.49 and if you wish to settle the dues lesser than the actual dues, please revert for us to advice you accordingly."

This shows that they have adopted this practice to extort money from innocent customers.

Dear Pooja,

Your information is neither complete nor properly linked chronologically. Can you suggest, how the experts should link your information with the reported dues of Rs.62709.11, overdue of Rs.2,000 and also Rs. 66,779.49 and on which dates did your friend get such mail or communication, whether in 2004, in 2012 orior to his approach to CIBIL or after her email to CIBIL? Frankly speaking, such a delinked query was not expected from a person of the status of a company secretary with CS and LLB qualifictions.
