please, give me opinion "when a constable of haryana police facing four departmental inquiry and out of them in one D.Inquiry he has been discharge---- in such case rests of the three inquiry will have to proceed further or not?"
Advocate. Arunagiri (Expert) 05 February 2011
Each inquiry is independent, he has to face all the other inquiry.
Kirti Kar Tripathi (Expert) 05 February 2011
Correct view, Mr. Arnagiri is right. Every inquiry is independent.
Ajay Bansal (Expert) 06 February 2011
AGREED WITH AFORESAID VIEWS.
samiullah sayyed (Expert) 06 February 2011
THE REST OF THE ENQUIRIES CANNOT PROCEED FURTHER IN VIEW OF THE FACT THAT THE CONSTABLE HAS BEEN DISCHARGED AND THEREFORE THERE IS NO RELATIONSHIP OF EMPLOYER AND EMPLOYEE ALLOWING THE DEPARTMENT TO PROCEED FURTHER WITH THREE OTHER ENQUIRIES. HOWEVER, THE ENQUIRY IN PURSUANCE TO WHICH THE CONSTABLE HAS BEEN DISCHARGED CAN CERTAINLY BE CHALLENGED IN THE COURT.
