Hello Members
Eviction petition of one shop filed by two landlords on the ground of personal bonafide necessity of their respective sons, the same was dismissed as withdrawn without permission to file a fresh petition.
Second eviction petition was filed by both the landlords/brothers for personal bonafide necessity of same son of one landlord only after one month.
Whether second petition is not barred under order 23 Rule 1 CPC and section 14 of Haryana Rent Act?

he provisions of Order 23 Rule 1 (3) of the Code of Civil Procedure are not applicable in rent proceedings in view of the judgment of the Division Bench od Punjab & Haryana High court in Ram Dass's case (supra) hence fresh petition is maintainable.
