Dear experts, we are two brothers,my father has self earned property as well as ancestral property..in 2005 my father disownd my elder brother and his wife from his self earnd property and he also made a registrd will in which my father registrd my name as his nominee and also mentiond that my eldr brother and his wife or any1 relatd to him would not hav any share in his self earnd property.. my query is when my brother's child will be in adult age can he claim his share in said property ..? if yes what should we do to avoid that situation..

What about the ancestral property whether the proportionate share that 1/3rd is settled to your brother legally.Once it is done the will would entitle you only for the self earned property of your father. To safeguard it probate the will and change the records legally with regard to the self acquired property of your father which would be exclusively for you.

Your father was competent to bequeath his self earned property through a properly executed will. The crucial question is, whether a proper will has been made or your father died intestate?

Have similar view as that of all the experts.
my father is alive , and he has made a proper registrd will with witnesses in my favour,i was jst worried whether my brother's child has any right to claim in that property in future after my father..because my father had already disownd my brother.. thanx
