Dear experts,
Whether advocates office is a commercial activity office for the purpose of charging electricity bills on commercial rates by the Electricity department for electricity consumption.

It has been held civil appeal no. 1065/2000 (Chairman, M.P. Elecrticity Board and others V/S Shiv Narauan and others) by a three judges bench of the SC that Energy consumed by advocate in premises away from residential premises and exclusively used for professional purpose- is an activity of commercial character and to be charged commercial rate.

thanx mr Ramachandran.....but how should i approach the electricity department for not charging the commercial rates for electricity consumed.
whether through court,by making an simple application to them or any other way you may suggest Sir.

If the advocate is having his office cum residence, it is a not a commercial usage.
If the advocate is having a separate and exclusive office, it is definitely a commercial usage, commercial EB charges applicable.

Yes. If you want to avoid commercial rates you may have your office in ur residence itself.
