hiding criminal case from company

(Querist) 20 September 2013 This query is : Resolved
Hi all,
One of my innocent friend has a false criminal case pending against him.

He was not having any case at the time of offer letter i.e. selction.

But, before joining company a criminal case is registered against him.

He hide this from his employer. What can happen if company finds this out?

Does it can lead to any disciplinary action??

With out knowing the case no positive advise can be given.
Adv. Chandrasekhar (Expert) 20 September 2013
At the time of offer of appointment, if he had not any criminal case against him and if he gave the resume to such an extent, it is O.K. But at the time of joining, he was not required to file any form indicating whether he had any criminal case and if he had not filed any such form, then it cannot be called "concealment". But the real problem arises, that the service conditions, in most of the cases, impose obligation on the employee that during his tenure, if he faces any criminal case, he should inform the employer. If that is the case, he should inform the employer. Otherwise, employer is entitled to initiate disciplinary action against him at any point of time during his tenure.
