High court appeal- fast track

Respect all,

I am accused in false 354 by neighbours with objective of taking illegal expansion of house over our house.

Can i ask high court to transfer the case to fast track court on grounds that many cases of similiar sections are in fast track court like mumbai gang rape and bapu case etc. court of law is equal for all.

What are the chances that it might be transferred?

The victim husband is an mla affliated person and having strong political support and troubling us on daily basis. When we resist them they falsely complain in police that we are threatening them to take the case back. Court has also given them protection via police. God is also not helping me. Please help.

How long the case is pending/
If it is pending for long with little progress then you can apply for expeditious disposal. No need to send to fast track court. It takes same time.

Civil matters are not advisable to FTC.

It is a criminal case u/s 354. objective are civil benefits. One year has passed. Prosecution evidence have started . Not enough human resources in court to type the statement due to which new date was given.

What is the procedure for expeditious disposal appeal?

Prey the court for early hearing if pending from long time. Transferring to fast track is doubtful.

File application u/a 227 of the constitution of india in the high court.

Apart from the case pending any other sufferings you are under going? In that case you could request your advocate to file a petition in High court requesting the case to be conducted on priority.Otherwise just be cool since you are the defendant.These sort of matters going to FTC might be you are taking Risk.

There is no scope to transfer such petty type case to fast track court especially when the evidence is going on. After closure of evidence, the case shall be posted for the argument and then for judgment.

Some people saying..Is that true that in 354 there are very less chances of acquittal and court only rely on lady statement and honesty is counted less against lady statement.

Bcoz on my case the lady has crammed the lines prepared by her husband mla affliated person and she shouts every-time that molestation incident has happened.

I just wonder that in 354 you are almost convicted outside the courts by society. Will i ever be able to prove honesty and will that lady ever be punished for misusing such women lAws.
