Hold (pralambhit) on ferfar for registered document

Hello Gurus,

I have registered gift deed of property to my spouse but my brother has taken objection for ferfar and it's on hold for last few months.
Property came from my grand father to father by partition and then father transfer to me and my brother in 1994. Since then I was owner of land by 7/12 and ferfar. Since all documents were ok, sub registrar allowed to transfer my share of property to my spouse name by paying stamp duty and reg. fees.
Can Talathi or circle office keep hold on registered gift deed ferfar?

How did your father transfer the property to you: say by gift deed?

Property came from father to me by partition 20 years back and relevant mutation entries are on land records.

Objection was I'm not legal owner of property and partition deed was not registered. However, partition was done 20 years back and all relevant mutation entry was on record. Also 10 years back, we have converted this land to Non-Agriculture and sold few plots by registered document.


My bro has eye on my share of property and he along with my father wanted my share back to my bro. He got his own same amount of share but he is greedy. He want all property. so he is troubling me by influencing Talhathi.

I have transfered my share to my spouse name by registered gift deed and paid stamp duty and reg fees. My Bro has objected on this transfer and mutation entry is on hold for last 4 months...

Was the partition registered?

It appears from the query that your father is still alive.

1>correct ...Father is still alive.

2>20 years back partition was not registered it was my fathers declaration on stamp paper to partition mong him and we 2 bros.

3>we(me & bro) have purchased new property 7-8 years back and have registered partition deed for new property.
In same registered partition deed we have mentioned that previous property listed in point is already owned by both bros. and enjoying that property separately.

"Gurus Let me put all points in sequence to make it more clear -
1> I have purchase farm land from third party from my salary by registered document on my name and got my name on 7/12 as per purchase document mutation enrty.
2> after 2 years, my father behind my back along with Talhathi transfered this land on his name bysubmitting partition decalration ( stating that I'm giving partition to my father - entire land ) application to tahsil office and Talhathi did mutation entry accordingly. Now my fathers name is apprearing on 7/12 instead of me. I'm not ok with this. I want my land back on my name.
please guide me."
