I have filed the consumer case in June 2011 at one of the Distrct Forum and shocked to learn that there was no staff posted there for filing process and other formalities as result I had to come many times mere for filing and when the case was admiteed and the Hon'ble president issued notices..and gave date for next hearing and agin shoccked to learn that notice has not been served sue to the absence of staff and i was advised for datsi notce and agin I had to come many times for getting the notices...Infuriated I filed the complaint to the Govt of NCT delhi Office for not deploying staff..but nothing come out..I apperd in Jan 2012 but the court was in session due to absence of staff and was given date of today and today agin it was adjouned for August 2012
As per CPA Act and rules frmaed there under in the matter has been disposed off with in 6 months but here 1 year matter has not been served..forget about the order and relief..Many litigants and advoctes have been crying for this irresponsible behavior but none come foward and many say that they will move to PMO nad report this too press
But for legal anagle, is it wise to move writ petition against the govt for necessary orders and directions

yes you can file writ petition in high court calling upon the goverment to take necessary corrective measure to fill in vacancies .sanction funds for smooth functioning of various distruict forums .for instance in mumbai writ petition has been filed in bombay high court for filling in vacancy in consumer forums

Vacant posts leave 19 Maharashtra district forums non-functional

Nineteen of the 40 consumer district forums in the state are non-functional for the last four months because of vacant posts.
This fact, through a public interest litigation filed in the Bombay high court, highlights that the state government is not serious about working towards upholding consumer rights.
On Saturday, the country will mark 25 years of enacting the Consumer Protection Act.
The Mumbai Grahak Panchayat, which has been striving for consumer rights since 1975, has moved the high court, seeking directions to fill up the vacant posts.
The oldest non-political organisation also wants Anil Deshmukh, minister for consumer protection, and Bhagwan Sahai, principal secretary of ministry of consumer protection, to pay Rs1 lakh which would be credited to the State Consumer Welfare Fund.
Advocate Uday Warunjikar, appearing for the panchayat, said: “The situation is so bad that the forum members are holding additional charges. They keep shuttling from Mumbai to Raigad.”
The information obtained by the panchayat through the Right to Information states that of the 40 district forums, 19 are non-functional because posts of 12 presidents and 33 members are vacant. The State Consumer Protection Council, established in 2003, has not met even once. The District Consumer Protection Council has not yet been formed.”
The division bench of chief justice Mohit Shah and justice RS Dalvi issued notices to the state government and president of the Maharashtra State Consumer District Commission to file their replies by January 17.
“This is a sorry state of affairs and the plea is not only to fill up the post within few months but to also levy a penalty on the authorities,” said Warunjikar.

this is a condition for all over India. Even in Kolkata one forum for consumer disputes is functioning without President for more than last 5 month.
