House purchase problem

(Querist) 22 February 2013 This query is : Resolved
Dear sir,

My parents purchased a house 15 years before and we all are living in that house.the person who sold a house was a lawyer.he was expired 5 years before.

that sold person had 2 houses in the same place in that we purchased 1 of the house and they given that another house to his son.

* Question

> Now sold persons son is telling his father sold that property without his knowledge so this sale is not right.he is telling that house belongs to him.

> what i want to do ?
> is he having any rights ?

what was son doing for 15 years ? i presume house was in name of seller and agreement was duly stamped and regd .

lawyer while selling the house must have taken all legal precuations .

cross check your agreement for sale . was lawyer sole onwer of property or was it in name of father and son . contact a local lawyer

You need not to afraid. If the seller was absolute owner of that property and the same was not his ancestral then the consent of his son was not required at the time of sale and so you not to worry. let that person initiate legal action against you before the court of law.

dear sir thanks for kind advice.

No sir that property is in the name of person who sold (lawyer) only.

this property is not a family property.that sold person purchased this property from some other person.

But everybody telling,if a father selling property to some one,at the time of selling the father must get the signature of his son in witness.

is it real ?

that son telling every time . how my father sold this property with out my knowledge,.. like that.

is there any rights for his son ?
ajay sethi (Expert) 25 February 2013
as already advised son consent not necessary . he need not be a witness too . let him move court
