How a property can vacant from tenant

(Querist) 27 September 2010 This query is : Resolved
If a person purchase a house and in this house there is a tenant on some space. Whether a new rent deed agreement is required with the new purchaser of property. If purchaser is not ready to go into rent deed agreement. how a landlod could get vacant the space for tenant.
Devajyoti Barman (Expert) 27 September 2010
No new rent agreement is required though the landlord is needed to send the tenant the letter of attornment to the tenant so that the tenant is known about the landlord for the purpose of paying rent.
However if the new landlord is not ready to continue the tenancy then he will have to file a case for the eviction on several grounds including for reasonable requirement of the tenanted premises but only after giving him a 1 clear month notice to vacate.
Consult a local advocate.

Yes sir but unless your requirement is not more reasonable the tenant will be protected, normally no eviction possible.

Even after final decree from SC the execution decree is contested and it takes years and years and years to take possession.

Check the rent Act in your State.
adv. rajeev ( rajoo ) (Expert) 27 September 2010
Yes, new rent deed is necessary. If purchaser does not want to continue with the old tenant he has to issue legal notice under the transfer of property act, if tenant rejected to vacant then he will have to file a suit for possession.

But if there is a bonafide requirement of the new landlord and he does not let out the permises and his requirement is bonafide one without any other residential accomodation the need of the landlord will prevail over the tennant.
G. ARAVINTHAN (Expert) 28 September 2010
attornment of tenancy is necessary
