Try to take information regarding her income especially her IT return.
You can ally for discharge of other relatives from DV case. That apart you have to fight the case on merit.
Mere separation is no ground to dismiss DV case.

")her father running real estate business behalf of her name and cheated number of people (cases are also claimed on them)"
How is this relevant in divorce or DV case?

Prove her income.
Defend DV
It seems she is ready and willing to live with you,
And u don't want her.
If so, Court will allow mtn. to her, [unless u prove her earning]

You have to defend your case on merits. She is ready to live with you or posing so, and it seems you are not interested to keep her with you or such impression has emerged in the proceedings.
a) You have to prove her earning through acceptable proofs.
b) Whether any FIR has been lodged for cheating in her name by her father, if not, no effect.
c) Engage a seasoned criminal lawyer to defend your DV case.
