How can i stop mutation?

(Querist) 03 October 2012 This query is : Resolved
My grandfather died few months ago.My father's brother has applied for mutation through will. How to stop mutation of this property whose owner is my grandfather?
Sudhir Kumar, Advocate (Expert) 03 October 2012
If he has got a will you cannot stop.

You can challange the WILL and delay the matter for some time. But be sure that the relation (which is always more than the worth of property) will be gone fro ever and it later on causes emotional stress whichyou cannot bear.

If the will is genuine then no remedy.

If void or voidable a suit of cancellation is the remedy.

Why was your father discorded?

Was it your's Grand father's self acquired property or inherited property are some other questions to be dealt with in this regard.Better consult a local lawyer with all facts.

Mutation on what basis, whether he has the will signed by your grandfather in his favour or got the succession certificate for the property of his father? You have not stated any background of the problem.
Raj Kumar Makkad (Expert) 04 October 2012
If you have come to the conclusion that the will is fake or the property in ancestral then go to civil court and challenge it and get stay order against the implementation of the will. This is the only way to get the relief as you have sought.
JANAK RAJ VATSA (Expert) 05 October 2012
challenge the will on grounds after discussion with your local advocate
