How remove partly stay on my property

Sir my father had bought 80.sq.meter plot in gandi village on 26.6.1991 after few years he built a house and we all family members have started to living there in 1999 my father died and after 7 years i got problem from house due to old construction that's why I had demolished whole construction and start new house construction for that I have grant housing loan i have submitted all documents of property like 7/12 entry which is mentioned my name and my mom's name on his property ,property card ,panchayat approved lay out plan as well as construction permition of 1991,then one of my neighbor file case on me that I am constructing house on open common plot in court i have produce document of my property of above i mentioned and and others neighbors house panchayat records who live beside me in same plot in the court the applicant produce land record drawing plan which mentioned on our plot is open space but strangly his sale did there is no indication that this property is common plot finally court ordered partly stay to stop construction ...Now i Have appeal to upper court with additional proof like my electricity's bill voter id card ,my house text bill payment and sitysurvay superintendent drawing. In this drawing there is no open space ...So what is the merit of my case ...I can hope to win...

Once you proved that there is no open space in the drawings to the said plots, you can succeed the case in an appeal. The High Court may give finding in your favour.

Generally, no further evidences can be submitted in appeal process.
