How to apply for speedy trial.

(Querist) 06 April 2015 This query is : Resolved 
I am facing 498a (4yrs)and a maintenance case (3yrs)for a long time now; recently I managed to get exemption from personal appearance in both the cases after guidance from the esteemed panel of experts of the lawyer’s club thank you all, but that still doesn’t make me a free person.

I would like to speed up the trial process so that I can truly call myself free. And prove my innocence to the society.

I am requesting your valuable guidance regarding
1) How to apply for speedy trial

2) Any sample drafts available that I can use to prepare my own application
(if the drafts cannot be put in a public forum my mail id upendra_babu@msn.com)

3) Where should it be applied district high court immediate superior to the current magistrate court or the state high court
____________________________________________________________________________
4) Should I apply it in person or ask my current lawyer to help me (he might not be willing as the current judge might view it as a complaint against him.) or I can use another lawyer from the higher court, or should I ask my current lawyer to suggest any friend of his in the higher court.

You can apply in high court under revisional jurisdiction for speedy trial. Consult a lawyer, he will draft the same. Attach the certified copies of the order sheet of lower court with your application.
