How to collect my amount

dear sir,
I give amount rs 3lack to my friend at 2009. he promise to paid install mentally,
that amount is rs5000 p/m. but he is not paid continuously. his total amount paid is rs 90,000 only. present his said i will not paid at any circumstances. give me the procedure how to collect my amount through court.

to establish your case, you have at least a documentary evidence to show that he has taken the money from you as loan or you have given money to him as loan. In the absence of the documentary evidence, it is very difficult to collect. The rest of the proofs are secondary.

thanks, i have promissory note. i think it is consider for documentary evidence.but in this no witness signatures.if it taken sines at present is considerable. plz let me how to file the case.

Promissory note is good documentary evidence, consult your lawyer.
