How to find out the ownership change of my parental property

(Querist) 18 February 2014 This query is : Resolved
Dear Sir / Madam,

We are three sisters and one brother. Brother is eldest, i an the second daughter of my parents. We were resident of Delhi. I got married on 2002 and came out from Delhi along with my husband.

We have one property which was in my mothers name. My mother was expired on 2002. After my mother passed away, my brother was asked us to sign in a blank paper stating that this will be required for withdrawing the Post Office small deposit which my mother had and she did not have any nominee declared in that deposit scheme. We did the sign.

Now, all the three sisters having a doubt that our brother have transferred the ownership of that property in his own name. Please note my Brother and Father are staying in that property. As far as I know, all children having the equal rights in Mother's property.

The first step has to find out whether the ownership of that property has been transferred to my brothers name ? PLEASE GUIDE ME HOW TO FIND OUT WITH OUT MY BROTHERS / FATHERS KNOWLEDGE ?

Then we will decide for the legal option. If we go legally, will it help ? Please suggest.

Some points to be noted :

1. All the sisters got married and staying in their in-lays house.

2. My brother is still unmarried. Aged about 45.

3. My Brother and Father are staying in that property only.

4. We are normally visiting there once in a blue moon.

Please suggest me on the above.

With regards,

Mamtha

You can apply for encumbrances with the registration office. It could also be ascertained with Delhi metropolitan office for name change.

EC(encumbrance cert.)from registrar of of property registrations will show all changes of ownership.
in some states the govt.have made it online also.where we can see online the EC for example :www.igrs.org(inspector general, regn.and stamps)website ,where we see online and take print also.
simply put the above words in google search.in case the local state govt.made it online ,u may get it.

Get the encumbrance certificate and know the actual position.

Your brother is not married aged 45 years, you have been visiting him. your shifting to that property is doubtful as all sisters are living in their matrimonial house. As per present position after your brother and father the property would go to all the sisters. May wait till that time. This would not spoil your good relation with your father and brother.

Choice is yours.
