How to get a subdivision for an UDS.

(Querist) 19 March 2016 This query is : Resolved
Hi, I purchased a property in my mother's name, measuring a 1200 sq.ft undivided share of land in the whole area measuring 2900 sq.ft along with 650 sq.ft of building and the remaining 1700 sq.ft along with 650 sq.ft of building is held by other party registered in his name and it is a twin house model. Now we (i.e., me and the other one) would like to have a seperate patta for their respective piece of land by getting a subdivision. Could someone please advise how to proceed further and what has to be done from both of us to get the land subdivided and become an absolute owner for their piece of land? Also please clarify, if the land get subdivided, would this give us (both party i.e., me and the other one) a clear title on the seperated land i.e., absolute ownership?

Many thanks in advance!

all basic documents and papers need to be referred for opinion.

On the basis of your query, You can enter into registered partition deed with the other party.

Thank you Sir!
Could you please clarify this?
Is that sufficient that one of us enter into registered partition deed or should both of us have to register a partition deed for our share?
P. Venu (Expert) 20 March 2016
You can execute a partition deed and subsequently have the mutation carried out.
