How to get money back taken by fraud

Hi there
I have been a victim of fraud and a very large amount of 16 LAKH RUPEES Have been withdrawn from my bank of baroda account by a very close relative who has forged my signiture on a cheque and cashed the cheque by opening a new account in the STATE BANK OF INDIA.
Bank of baroda are refusing to refund the money stating untill the police do not arrange a FIR.
The police are very slow to action and raise a fir and i am stuck in the middle.
What right do i have to claim the money from the bank.
Is the bank within its right to wait for police FIR to be issued.
Am i able to claim from bank without a FIR.

FIR is must in this case, try to give representation to the higher police officials too.

If police is not lodging FIR then file a complaint under section 200 read with section 156 (3) of criminal procedure code and get the desired results.
