How to get registration certificate

We own a shop in mumbai which is developed under SRA scheme. The shop's key was handed to us after 4 years from the completion of project date.

Builder and secretary are not giving us Registration agreement and possession letter. We have given them several notices however, secretary says they have lost our registration agreement.

We have following documents at the moment:
1)Sales certificate.
2)Annexure II(our name is mentioned).
3)Gumasta license
4)Electricity bill on the owner's name.
5)Maintenance receipt till date.

Queries:

1) Can we sell the shop with above listed documents ?
2) How to get Registration agreement and possesion letter ?


Kindly help us to find a solution to this problem. Thanks in advance.

There was your son,here is your shop,ram you are truly RAM!

Any way :
1)YOU CAN provided you also obtain the certify copy of sale together with a declaration on a notarized affidavit from the builder that he has loosed the original.

2)Apply in the concerned sub registrar office for a certified copy after inspection of details paying prescribed fees,these all is open to any member of publc.

without copy of agreement no one will purchase your shop . contact a local lawyer .

buildrer is bound to igve registartion agreement ie agreement entered into by builder with you .

was such agreeemnt executed? how was it lost?

if such agreement is not executed at all move consumer forum for deficency in service against the builder / society .

Thanks Mr. singh & Mr. Sethi for valuable information.

Mr. sethi:

Builder & secretary says we have registered our shop but they have lost the certificate...when we asked them to give it in written they are ignoring and saying if you want to sell then we are here and we could sell it anytime.

I will approach the sub-registrar office first with all the documents i have.

Also, if you could let me know...how to find property registration number ?

if shop has been registered they are bound to give you original documents .

they have to give in writing they have lost it or should lodge police complaint about loss . gross negligence on part of duo .

geenrally builder keeps a copy of agreement with him . it must be containing registration number .

ask builder to obtain certified copy of agreement for you

or sell your property if you are getting good rate

Selling would not be possible because he has given shop at the other end of the main road where most the people do not come so no would purchase the shop and talking with builder is waste of time.

So far no notice has been sent to builder/secretary and only verbal communication is going on.

Shall i lodge a complaint for not providing the registration agreement of shop in police station ?


Also, From where i would get possession letter ?
