How to release our vehicle from police custody

My brother met with an accident while travelling by his bike few days back and died on the spot. Police lodge an FIR of the case and taken custody of the bike.
There is no witness of what happen during accident. How can we get our bike back from police custody? What is the procedure?
Will the bike be released on superdari?
and how to sell it as the vehicle is on my bother's name?

Seek help of some local lawyer, so that he may move proper application for Superdari.
The vehicle can be sold only with the permission of the court.

The legal heirs of your deceased brother shall have to move application for sapurdari and thereafter its ownership shall have to be got transferred in either of the names of the legal heirs of your brother and after finalization of the case, the same can be got sold.
