How to respond to false police complaints?

(Querist) 30 January 2014 This query is : Resolved
Due to prejudice my neighbours living in the 1st and 2nd floor have joined hands in harrassing me by using police influence. Being localites they have mob strength .. after exhaustive visits to commissioner's office, women's commission and human rights commission ..... and finding no alternative .. I have gone ahead and filed a civil suit asking for permanent injunction against these inmates ,so that they may not interfere with my peaceful possession of my property. My case has not even come up for hearing the past 4 months. Recently, these inmates have again gone to the police and filed false complaints against me. The police continuously call me to close the complaints. Having done this for more than two years, I am put to agony having to visit the station to close these complaints. What is the solution to this? Please suggest on how to end this wilful manipulation of public authority by these inmates to harrass me and drive me out of my house and job.

Compalint for which section? or offence?
V R SHROFF (Expert) 30 January 2014
what offences are leveled against you???
Devajyoti Barman (Expert) 30 January 2014
anyone can lodge complaint against another even if the same turns out to be not proved. The allegation is false can only be proved if the same is tried in court.
It is better to shift this locations as it is really hard to stay with such kind of neighbours.
You are however silent about the nature and cause of such allegations.

Nature of offence shown in individual police complaints can only be the guiding factor separately.

No body can prevent such complaints, have to face the procedure.

Better try to shift to another premises.

You should fight.Consult a near by good lawyer.Mere shifting is not a solution.Death is a common factor and mere shifting will not assure you life for ever.No assurance your shifting of place is safe place. In a country like our India dont be coward and face the devils

You can move the High Court under 227 seeking timely hearing in the civil action.

The allegation levelled against me are false by nature .. they are restriction of movement in common area(they visit it every day),planting trees in common area(the common area is clearly marked as garden space in layout plan and is maintained as such for the past 40 years). These inmates have said in the station that they want to use it for parking space just to intimidate and harass me, inspite of other garden areas already used by them for parking.I have shown police several videos of these inmates coming down and chopping n breaking plants, exposing private parts and using severe abusive language, they even threatened to murder my father a senior citizen but police do not care. Police just seem to take any complaint given by them since they go in groups, perhaps police are intimidated by their strength. I thank Mr.Narasimha for his positive reinforcement. Are false complaints not punishable by nature?

Even chopping the plants and trees when it is in its place is also an offence.Take the help of organisations like Civic Exnora etc near by.

You also organize a goup of people i your favor, since you have mentioned that it is a common area, other common people's interests in that area is also affected, so take the help of other common people, gherao the police station to take action against the erring tenants.

Dear Sir,
Just to update .. I got in touch with exnora but they seem to be more established in Chennai. I have approached some other environment organisations .. they have agreed to help to approach the tree officer in my area. I will keep this line posted ..if I find a solution.
