How to stop the issue of patta

I have a query regarding my grandfathers property. He had a property of 4000 sqft land. The property belongs to my great grandfather and my grandfather had written the property (uripa of memorandum) to my father and his brother each one 2000 sqft land and expired on 2005. But my fathers brother keeping original documents (uripa) he says the whole property is mine and the government has recently given applications for issuing patta in our area. My father is working in abroad and my father’s brother should not get the patta. If he gets the patta may be he can throw us from the home.
Could someone guide us handle this situation and stop patta

Ask your father to file a suit for partition and injunction. Since he is in abroad he can give POA to any of you to conduct the case.

Well Advised by above Expert Simultaneuosly You Could also Issue Notice to Concerned Authorities Regarding the Litigation in Detail asking them Not To Proceed with Issuance of Patta.Consult a Local Good Advocate with all the relevant Documents.

where he claims that he is practising from 2001, while as already indicated by me, he was enrolled only in the year 2012!!! CAN ANYBODY PRACTICE BEFORE ENROLMENT? IF ONE DOES SUCH A PRACTICE IS HE NOT FIT TO BE CALLED A "FRAUD"?

Yes a partition suit by your father will be a good option, in which the Tahsildar can be impleaded as a party and an IA for restraining him from issuing or transferring patta till the disposal of the suit may be added.
