My client is having driving licence endoresed as HPV" but at the time of accdent driver was plying Truck,for which HGV licence is required,Kindly advice wat i have to do now.Claim petition is fixed for written statement.

your client did not have a valid license revealing which the insurer shall escape from liability for want of valid driving license.

There being no valid licesnse with the driver, no claim would rest with the insurance company. Do, your client (driver) or the Truck owner can be held responsible for compensation. However, if you want to save your client, the buck can be passed on to the truck owner on the plea of carekessky taking duty of driving of HGV from the driver having no valid licence for that.

your client was not holding valid licence at the time of incident.Insurer may get exoneration on this ground.also pls.let me know whether clasim has been filed u/sec.166 of m.v.act or 163?
