I have Driving licence for driving Heavy Transport Vehicle and Heavy Passenger vehicle, i met with an accident while driving a truck and now i am facing a claim petition and crl case us 304 A .I want to know my DL is valid or not in given facts or i required a heavy goods vehicle (HGV)licence .Kindly advice.

Truck is a Heavy vehicle so it meets the legal requirement.

Criminal case has to be defended on various grounds as per situation and it your DL is otherwise valid and insurance policy is also valid then as per routine orders, liability shall be fastened upon the insurance company.

i have been thinking so since long but could not dare to comment.

Now coming to query since your licence is for transport vehicle you have a valid driving licence and have right to drive a truck,which is clear from section 10(2)(e)(ii)below: ......

[(e) transport vehicle;]

(i) road-roller;

(ii) motor vehicle of a specified description.
