Husband and wife living seperately

(Querist) 17 December 2012 This query is : Resolved
Respected sir's

My sister in law was married 3 years back, and she has given a birth to a baby boy, 1 years old now. But her husband is not behaving with her properly , for instance, not allowing to enter into pooja ghar, not allowing to use bathroom, mentally harassing her by using a bad words. in this regard we had lodged the police complaint (not registered), the lady sub inspector had strictly instructed her husband to behave properly. The situation was ok for few days only, but after that he again stated harassing her, now she had left her husband's house and are staying with her parents since last 2 months, and till now he never called up or tried to contact her. Husband is ready to take her home on condition that, her parents and relatives should not come to visit his house and police complaint is to be withdrawn. But we are unsure and have no guarantee about his behavior.

Dear sir kindly suggest in this situation what to do

visit a marriage counsellor . for sake of one year old child try to save maarriage .

Try to counsel them , they need counselling. You can initiate legal proceeding but they may wreck her marriage and the future of child.

Saving of marriage do not mean that your brother in law should be permitted to again tease and harass your sister. Police complaint should not be withdrawn rather your sister should go to her matrimonial home and should observe his behaviour and at later stage should withdraw it only otherwise things can again reach to the state from where those had started.

But sir, is there any family court or counselor in existence to resolve such kind of matters. which will help us to save the marriage.

further even if he do not agree, then what kind of legal action we can initiate against him. as my sister in law is hardly 24 years old. and she has a ample of years to go in her life.
ajay sethi (Expert) 18 December 2012
yes there are marriage ciunsellors available for counselling
Raj Kumar Makkad (Expert) 18 December 2012
There are lot of such counselors and if negotiations fail, your sister can even go for divorce apart from claiming her right for maintenance, right for residence, right for protection etc.
