I have applied for divorce still wife is calling in mahila aayog

Hello Experts,

I have filed for a divorce in Kalyan Court on basis of Cruelty against my wife who stays in Malegaon with her parents and brothers. They have received a summon from a court and they have to attend the hearing in next week but before the hearing they have approached "Mahila samupdeshan kendra " in police station at Malegaon. I have a got a letter from MSK to come and meet them for counselling. Is it mandatory to meet them ? As they have put my name as well as my 7-8 relatives name to meet them in Malegaon. Her brothers are like Gundas and they have local influence and that can be life threat to me as well as to my relatives. Can they file 498a and other cases if I dont attend the counselling ? What is Zero FIR will the case gets transferred to Kalyan instead of me visiting to Malegaon.

I have send sent a register post to Mahila Aayog stating that I wont be able to attend on the said date mentioned by them , But they have refused to accept my letter from Post. I have a acknowledgment for the same.What should be my next Action? Should i still go , I think Mahila Aayog is corrupted and biased over there

She is entitled to explore the remedy available to her even if her contention may be wrong.

There appears to be no wrong in putting forth your view in Mahila Thana.

In case the said complaint results in FIR then it will not be transferred to place of your convenience.

Once you treat your better half as worse half, you can expect anything worst to happen to you from her side, as law also supports her unquestionably.

You will have to attend wherever summoned.

Better deal with the case patiently, if really facing any such problem.

Experts , I dont want go there as I know its going to completely biased they are not going to listen to me even I have enough evidences. I want case to be handled by Court.

Your wish not to go there has no relevance for them.

If you keep the evidence preserved with you how you can convince the Mahila Aayog about your innocence?

Let Mahila Aayog do its own functions and the court its own.

1. DIVORCE proceedings before a judicial court is classified as "sub-judice".

2. Mahila Aayog does NOT have any jurisdiction to interfere in "sub-judice" matters.

If the divorce case is pending that does not mean that the Mahila Thana is precluded from examining the feasibility of recommending FIR on the alleged offence.
