I want my wife to stay at my hometown (rcr) can it is possible in the eye of laws

(Querist) 14 November 2014 This query is : Resolved
I am from Bareilly (marriage solemnized in Bareilly) working here in Delhi (rented accommodation), I married in the year 2010, my wife is living with me. I do not have health relationship with my wife.

My in-laws are living in Delhi

My planning is that I send all my house hold goods to my hometown Bareilly which my wife is denying.

Can I send my all the house hold to my hometown?

Is it legally necessary to stay with wife after marriage where you are working i.e Delhi.

Actually my wife fight with me and my mother so I decided to send both of them to my hometown and after that I will start living in Paying Guest (lot of money will be saved of mine)
In the above scenario I will go to my hometown every weekend.

Can my wife sue me in court (IPC) for preventing me to do so?

Please guide me on the above scenario

Is it more or less similar to RCR?

Please guide me actually I got frustrated by my wife wrong attitude towards me and my mother so I decided to send both of them to my home town

Is any police case will be filed in the above scenario

If wife doesn’t stay (RCR) with me for more than one year in spite of my request is liable for divorce at my hometown (ground of cruelty)?

Any Help would be appreciated!!!

Yes, you can no force your wife to move away though you can stay separately.
Being her husband it is your legal and moral duty to maintain your wife.
Ido not think for petty quarrel you should think in this line.
Think to develop this relationship which may take time than damaging it further.

agreed with Mr Barman I reply to each of your sentence. I hope you may be benefited (may be annoyed as well)

आप पहले फ़ैसला कर लो की पत्नी के संबन्ध आपके साथ खराब हैं या आप के माता के साथ

YOU CAN AT THE MOST SEND YOUR MOTHER WHICH YOUR WIFE CANNOT OBJECT. YOU CANNOT SEND HOUSEHOLD ARTICLES (EVEN IF PURCHASE BY YOU AGAINST HER WISHES

Reaction

YES. SHE HAS A RIGHT TO RESIDE WITH YOU. WHEN HER RELATIONS ARE NOT GOD WITH YOUR MOTHER THEN YOUR ACTION OF SENDING BOTH OF THEM TO NATIVE PLACE (AWAY FROM HER HUSBAND AND PARENTS) CAN PUT YOU AND YOUR MOTHER IN TROUBLE.

शाबाश| कुछ इससे ज्यादा गैरजिम्मेदारी वाला प्रस्ताव लाओ|

YOU ARE ACTUALLY SENDING HER TO HOME TOWN AS A PUNITIVE MEASURE TO TEACH HER A LESSON FOR FIGHTING WITH YOUR MOTHER (SHE MAY HAVE A DIFFERENT STORY REGARDING MOTHER’S BEHAVIOR BUT ANYWAY IT IS MALE’S PARENTS WHO ARE TO BE RIGHT) SO THAT THERE YOUR MOTHER MAY BE INA BETTER POSITION AND SHE BEING AWAY FROM HER PARENTS.

NOT IN THIS CASE

PLEASE DO NOT THINK YOURSELF MORE CLEVER THAN YOU ARE.

IN THIS CASE YOU ARE SHOWING CRUELTY BY FORCING HER TO BE AT HOME TOWN (I) WITHOUT YOU (II) WITHOUT HOPE OF JOINING YOU (III) AWAY FROM PARENTS (IV) FORCED TO LIVE WITH YOUR MOTHER WITH WHOM SHE CANNOT ADJUST (YOU ARE FREE TO PRESUME MOTHER TO BE EVER CORRECT)

This is what is appearing from your own description of facts and planning.

It is upto you to be annoyed or get benefited by these views.

When your wife speaks she will have harsher facts. So better not to compel her to take shelter of law.

Such step from you would increase your troubles. Try to have amicable solution. You may not get divorce in 5-7 years if your wife does not want.

Expert Sudhir Kumar has analysed your situation and has tried to show you correct picture. Have positive attitude.
ajay sethi (Expert) 15 November 2014
you cant force your wife to stay in your home town . arrive at an amicable settlement with your wife
Sudhir Kumar, Advocate (Expert) 15 November 2014
I partially disagree with Mr Ajay Sethi.

Amicable solution can be suggested for a person who is already in trouble.

This person, born 150 late, is in 2014, just asking price of seed and fertilizer and yet to sow crop of misery and later have bumper harvest.

Amicable solution is hidden in my observations. He will find if he needs it.

Very well analysed and advised by the experts especially Mr. Sudhir Kumar.

To add to the above I would like to ask the author,
Did you marry to stay put with your wife, enjoy married life and grow more and more or the marriage was solemenised for the sake of getting married and throw her out of your society if she has some difference of opinion?
Bad boy.
T. Kalaiselvan, Advocate (Expert) 17 November 2014
Dear Author, you may answer the question raised by expert Dr. Vashista about your marriage.
Go for an amicable situation instead of developing the issues.
