Illegal possion on the basis fabricated documents.

I have a agriculture land 9 acres @ Aurangabad.I am government servant transferred to Nasik Adjacent my relatives land is there. So i given him to cultivate the land. During this he has prepared a bogus Heeba Nama on the hundred rupees bond and done notary, and transferred my land by talati,manageging Zonal officer and brought his name in 7/12. I came to know after one and half year. so i approached the talathi to see the real fact,firstly the talathi dint show me the document. so Right of information act demand the 7/12. His reply came after 3 months saying that he has no recrod off above matter. I moved by case to thye S D M
the hearing was started after o9ne year still going on. so pl guide me to get faster result.

Whether a power of attorney can execute a sale deed despite power of attorney being not authenticated under the registration act?

Depends on the contents of GPA as to whether he can sell it without registration. Secondly about the query pertaining to sale of Aurangabad land, you should file a criminal case of cheating also. Besides that you must file suit for possession of your land. The SDM has powers only about entries in Record of rights. This is time consuming process.

The GPA holder can not execute the sale deed unless the GPA is registered.

I feel you should file an application before the collector for cancelling the name of your relative in the 7/12 fraudulently got included. In my view this is the proper course of action to be taken immediately.Further you may consider filing an FIR with the police against your relative for committing forgery and cheating and follow up the mattter with the police. Since both of them are cognisable offences the police would act immediately and even arrest your relative.
