*******ILLEGAL SALE AGREEMENT/DEED OF APARMENT WITHOUT TRANSFERING 50% SHARE OF SPOUSE IN HUSBAND'S NAME*********
********IS IT LEGAL TO EXECUTE A SALE AGREEMENT/DEED WITHOUT TRANSFERING THE SPOUSE SHARE OF 50% IN THE HUSBAND'S NAME. SHOULD THE DEED BE CANCELLED AND NEW AGREEMENT EXECUTED AFTER TRANSFERING THE SHARE IN HUSBAND'S NAME.
******DOES SOCIETY HAVE ANY INHERRENT POWER UNDER BYE LAWS TO TRANSFER THE SHARES IN THE NAME OF THE PURCHASER OR THE HUSBAND. WHAT IS THE PROPER AND LEGAL PROCEDURE TO GET THE SHARE TRANSFERRED AND EXECUTE A SALE DEED IN SUCH CASES.
*****NB** CAN THE SAME AGREEMENT AND STAMP DUTY BE VALID FOR A FRESH DEED.
