my husband has illegal relationship with one lady and has an issue with her. he has filed divorce case but case is rejected by family court and he appealed in higher court. i dont have proof of marriage of him with that lady but have birth certificate of child. will he punished by 494 act.

This is a fit case for bigamy and the birth certificate would be of immense help.

That is not the answer to my question.
As you stated, "i dont have proof of marriage of him with that lady," why do you strike your head without any evidence. First get evidence and only then ask question based on the actual evidence. Legal suits cannot be won merely on guess or presumptions.
However,can you clarify, how do you happen to know about 494? You seem to be a law student and your q1uery as an academic query?

i m not a law student but a lady who is suffering from just after marriage and seeking advise by a expert lawyer so that a person who is responsible for all these things can be punished and nobody can spoil a life of a girl so easily.its not a joke. I hv birth certificate of their child showing my husband name as father's name. Her mother accepted in police statement that she heard about their marriage by public.

mother of that girl is accepted in police statement not mother of my husband. In birth certificate first name and middle name of my husband is same but he not added his title and the addres is same.
