Immigration law for uk citizenship for a person born to indian family in uk

(Querist) 07 September 2012 This query is : Resolved
Greetings,
I`m writing this email on my father`s behalf. My father was born in Bradford U.K.on 05/August/1958.He was born to an Indian family (my grandparents). My grand father used to work in UK,while my grandmother was a house wife.
My father was brought up in the uk till the age of 5,after which my grandparents returned to their home country (India).Ever since my father has been staying in India and is currently holding an Indian Passport. My father visited uk as a tourist in the year 1999 on a uk visa.
My query is does my father has the right to become a British citizen, even though he was born to an Indian family keeping in mind that he was born in Bradford, UK.(does the clause British citizen by birth apply for him)My father married an Indian.
Will my mother and myself also be eligible for a British nationality keeping in mind we are dependent on my father.I have my father`s birth certificate as proof of him being born there.
Thank you for your time in reading this email
Yours sincerely,
Mr Vineet Gupta.

Nationality and citizenship are decided by the country of birth. So, your father is Britih citizen by birth. But, if your mother and you are born in India, you cannot automatically become British nationals. Dependency has no relevance in this case. Rather, if your grand parents of father did not apply for and get citizenship of India for your father after his settling in India that may also not be legally valid.

Nationality and citizenship laws are quite complicated and time consuming issues and differ from country to country. So, you need to get in touch with some expert to hire his services for appropriate guidance/ advice on the issues.
