Imprisonment based on witness statements in accident cases

Querist : Anonymous (Querist) 27 December 2022 This query is : Resolved
If all the witness stick to same story during cross examination and chief examination. All witnesses narrate same statements that were there in chargesheet and all seem to identify the accused in the court and able to explain rash and negligent driving.

Can the accused be convicted and imprisoned just based on the oral statements and confidence of witnesses in the stand without any supporting evidence to those statements ?
T. Kalaiselvan, Advocate (Expert) 27 December 2022
If the prosecution side proves the case through its witnesses and if the court is satisfied with the depositions made by witnesses before the court in this regard, the court may proceed with the conviction of the accused as per law.
Advocate Bhartesh goyal (Expert) 27 December 2022
Plaintiff/complainant has to prove his case by cogent ( oral and documentary ) evidence through self and witnesses statement and after court being satisfied of evidence, the court will pronounce the judgement.
Dr J C Vashista (Expert) 28 December 2022
"If" the prosecution proves the charge(s) beyond reasonable doubt the accused shall be convicted and punished.
Answer to your question is affirmative.
However, why the facts start with "if" ?
What is your concern / problem / locus standi "if" it is not a hypothetical query?
Pradipta Nath (Expert) 01 January 2023
