In a regd hsg soc, taking over charge from administaration

(Querist) 24 June 2012 This query is : Resolved 
An administrator was appointed by registrar, during the period of his administration of more than 18 months, he neither conducted any AGM not presented a/c for two financial years (2010-11 & 2011-12). The elections were held for managing committee recently. Joint meeting of elected members of the managing committee & administrator held within 30 days of the election results but the handing over of charge is not done in stipulated 30 days as the a/c are yet to be audited. Administrator wants to hand over in the present form. How to take over charge from the administrator in this condition, pl advice for liabilities and remedies.

inform the Registrar in writing that adminstrator has failed to submit audited accounts . hence charge could not be handed over to elected managing committee

I need more opinion from other expert lawyers. If the administrator refuses to handover the charge, then what are other options?

Society should get audit account and find out misappropriation, if there, may file criminal complain.
