Income tax

(Querist) 18 April 2012 This query is : Resolved
How can I submit a return of p.y. 2009-10 , now? if not , what may cause of it?
Vineet (Expert) 18 April 2012
You cannot submit return for AY 2010-11 (PY 2009-10) now as the time limit provided for belated filing expired on 31-3-2012.

You can try filing return manually but the same will be treated as non-est but the AO may reopen your case for assessment based on the information provided in the return. If there is any taxable income on which tax has not been paid will be treated as concealed income liable for penalty. Further penalty for non filing of return will also be leviable.

Yes I do agreed. Experts opinion further more if any tax arrier then it will need to pay with interest and penality

In case you were liable to file your return of income for the FY 2009-10 AY 2010-11 then last date for filling of such return with penalty u/s 271F was 31-03-2012. Now since you have missed the bus, you cann't do any thing but wait for another bus, i.e. a notice from the department asking you to file the return. Pls note in case your income was more than the maximum amount not chargeable to tax for that year, you have exposed your self to penalty u/s 271(1)(c) of the act, because not entire assessed income shall be treated at income escaping assessment and penalty proceeding would invariably be intiated against you.

If you succeeded in submitting manual return, which i believe, department would not accept, you may plead not to be guilty of offence of concealing your income.

You may consult your local lawyer, who may help you submit your return within time allowed.
