I would like to know whether increments falling due during suspension period of an officer of a nationalised bank is payable.Himadri Shekhar Bhattacharjee

During the period of suspension, only sustenance allowance is payable. Since during the period of suspension no work is being performed by the employee, the period of suspension will not count for increment and conseqauently no increment is payable.

During suspension only subssistence allowance based on the salary last drawn before the date of suspension is admissible. No increments are allowed during suspension.
However, I may have to differ with opinion of Mr. Ramachandran in so far as counting of suspension period for increments. The suspension, if treated as invalid and treated as duty for all purposes on exoneration of the charged officer and is allowed duty pay, the increments can be drawn retrospectively from the due dates.

It will depend on the service laws under which you are governed and further Note 3 Rule 7 of Revised Pay Rules and FR 53(1) (ii)(a) and the clarification dated 27th August, 1958 it was held that if the revision of pay takes effect from a date prior to the date of suspension of a Government servant then he would be entitled to benefit of increment in pay and subsistence allowance for the period of suspension, but if the revision of scales of pay takes effect from a date following within the period of suspension then the benefit of revision of pay and subsistence allowance will accrue to him only after reinstatement depending on the fact whether the period of suspension is to be treated as period spent on duty or not.

I fully agree with the views of Mr. Dhingra.
But I am quite aware of the case of Mr. Himadri, who is under suspension and his query is only limited to getting the increase during the current suspension period, and not after the suspension period is over. That is why I had replied what I had replied.
Otherwise, what Mr. Dhingra has said is absolutely correct.

I endorse the views of Mr. Ramachandran. However, final result of grant of increment will depend on outcome of disciplinary proceedings. In case the charges are failed against the employee, he is entitled for increments and other benefits but if he is held guilty of charges, the result will be on punishment imposed.
