Information required if vehicle challan not filled within 3 months

(Querist) 13 June 2014 This query is : Resolved
Greetings,

I got challaned for my 2 wheeler for carrying expired PUC (Pollution Under Control Certificate) on 25 March 2014 in Gurgaon.

I visited challan authority in sector 51 and saw the road safety movie and tried to fill the challan, but got the information that my challan hasn't reached there.

On May 7th, 2 policemen visited my home and told that I have provided a photostated RC during challan and my challan wasn't accepted at authority, I checked in my documents and provided them the original RC (I was not aware that I have given them the photostated RC).

After than I have visited around 5 times sector 51 authority and each time I got the response that my challan is not submitted there by the concerned police station. I inquired in the Police Station and they said we will send today, we will send tomorrow. I visited them alsmost 10 days on daily basis but they didn't heard my request.

Today it is 13th June, 2014 and still my challan is not submitted by the concerned police station in the authority where I can pay the fine and can get my RC. As per my knowledge we have to clear our challan within 3 months from date of issue.

Please let me know how I can pay my challan after 3 months as police station munshi seems not in mood to submit the same for next 15-20 days.
Can there be a warrant against me for not filling challan in prescribed time.
What can I do to avoid the worst situation.

Please help me and let me kno what I should do in the above scenario.

Make a written representation to the higher police authorities by way of registered post and wait for its outcome failing which avail RTI Act.

Thanks Sir, for your response. I will send the written representation to the higher authorities as suggested.

Also, I have searched a lot of forums but didn't get anything regarding what are the consequences for not filling your vehicle challan in the prescribed time (3 Months), please have some light on the same.

Thanks!!

Welcome for your appreciation. In case the vehicle challan has not been got cleared then the police authorities can arrest such person and can produce before the concerned court for its decision. The court may impose heavy penalty and even punishment.

This seems to be a malpractice adopted by the police official. Report your case with challan copy to the higher police authorities and a copy to the district court. Challan is not accepted by the court? have some smell

Greetings,

Finally today I was able to pay the fine for my vehicle challan. I called the SHO of the concerned police station and he directed his munshi to send the same as early as possible.
Feels happy to see we still have honest police officers who really cares for the citizens otherwise I had lost my faith in the police.
Thanks to the members of lawyers club for guiding me to get the same resolved.
