This is regarding a female A, aged 40yrs. SHe has 1 brother. Her parents had a joint property which is a DDA Flat. Father of A died in 2009 leaving no will behind, her mother died in 2012 leaving a will which gives all the mother's share to the daughter (A).
The property is occupied by A's brother and his wife. They are not ready to give her the rightful share.
Please advise what will be share and how can she get it. Secondly in case of a suit what is the court fees, if any.

both son and daughter are the legal heir of deceased man.
daughter has mother share as per will and brother has occupy all share of property, daughter should file partition /title suit against her brother.
