Insectisides act

(Querist) 15 March 2013 This query is : Resolved 
as i was not hold license ,
crime was registered against me and the insectisides in my possession were seized.

thereafter before the judi magistrate cl-1
u/s 22 2b insectiside act,the insecticide officer had applied for the custody of the seized material.
but in due course of time i applied for liscence in my son's nameas i am old and not too active for marketing.
liscence has been issued in my sons name.
now,
i appoached the insecticide officer and as per sec 22 2c asked him to release my material seized by him.
but,,, the officer is denying and insisting the court for custody and auctioning of the seized material.

please guide. the chargesheet not yet filed

1. Powers of Insecticide Inspectors
1. An Insecticide Inspector shall have power-

to enter and search, at all reasonable times and with such assistance, if any, as he considers necessary, any premises in which he has reason to believe that an offence under this Act or the rules made thereunder has been or is being or is about to be committed, or for the purpose of satisfying himself that the provisions of this Act or the rules made thereunder or the conditions of any certificate of registration or licence issued thereunder are being complied with;



Your son have got the license after committing offence, so you have to face the trial.
