interpleader suit

I urgently need a model plaint for inter pleader suit. Also clarify whether a licencee can file a interpleader suit against licensor questioning his very right to give license to property. kindly please send me a model plaint for a interpleader suit.

dear sir
you file a suit by making both the parties as defendent. do not favour anyone.escape yourself from denying anyone s rights. instead say that other party is saying so.

Or.XXXV R.5 CPC prohibits agents and tenants filing interpleader suits against their principals. If u are a licensee and there is a dispute between ur licensor and another party, u cannot file an interpleader suit. U being a licensee may continue to pay the licnese fee to your Licensor and refer to the Licensor the claims if any received by you from third party for the payment of L/fee etc for necessary action by the Licensor.

Mr. M.V.Gupta is absolutely right. Interpleader suit is not warranted/sustainable in the given facts and circumstances.

Sir, I would like to know that, if the Building owner is not receiving the rent monthly, how can we pay monthly rent to Building owner. Whether we can file Interpleader suit ?

Dear Mr. Kumar u should have posted this as separate query, instead as part of a very old posting which is 5 years old.However I may inform u that if the land lord does not accept the rents tendered by u, u may deposit it in the Collector's/ Rent Controller's office with suitable application under the Maha Rent Act. Pl consult ur Advocate for details.No interpleder suit possible in this case.

You can send money order/cheque/postal order etc. by way of registered post on the address of the landlord and he even then do not receive, submit the same before the court of rent controller of your area.
