I have been appointed as Reader in the 5th pay commission scale of (12000-420-18000). Later in 6th pay commission appointed as Reader with grade pay 8000 (with a clause that I have to work on the scale of 8000 for 3 years and then i will be re designated as Associate Professor in the grade pay of 9000 after completion of 3 years)
After completion of three years I have been designated as Associate Professor. But just 2 months before completion of my three years in the scale of 8000 three people who were junior to me (on the post of Assistant Professor) were recruited as Associate Professor (Direct Recruits) on the scale of 9000.
I was working hard at 8000 scale for 3 years was adjudged junior to these three people who were junior to me before this direct recruitment. I think this is purely an injustice with me.
Seek legal opinion please.

please make so facts clear.
whether you are departmental promotee and whether they are direct recruits (even though previously service in feeder grade)
are they from subsequent recruitment year.

Dear Sudhir Sir, thanks for your interest and query.......
Actually I got appointed on the post of Reader (fresh appointment) in the institution (in 5th pay commission).
Then 6th pay commission was applied in the institution due to which I have been designated as Reader and given scale of 8000 AGP and asked to work on AGP of 8000 for 3yrs and stated in my appointment letter that I will be re designated as Associate Professor on completion of 3 Years and will get scale of 9000 AGP (Which happened as stated in my appointment letters)
The issue is, there were three people, one was lecturer (as per 5th pay commission) the other to were appointed first as Reader (but were junior to me for almost 2years ) Here at this point of time I was senior to all three of them for almost 3 Years in the institute records as well.
Now answer to your question is,
I am not sure whether I 'll be considered as departmental promotee or not because this was merger of post of Senior lecturer, Reader and Associate Professor (Merger of S22, S23 and S24 scales) to be designated as Associate Professor.
For the three people it was a direct recruitment (on a fresh advertisement of Associate Professor post).
They vacated there current positions and got appointed as Associate Professors. On there vacated posts other people were appointed. Whereas my post of Reader was converted to Associate professor. Even all three of them were on probation of one Year whereas I was not on probation. that means on the post of Associate I was confirmed after completion of my 3years whereas the three people were on probation for one year.

is it that they were working on a lower post and you were working as reader and both posts merged wef 1.1.6

Dear Sudhir sir, they were working on lower post and I was reader at that time .....merger was of senior lecturer post reader post and associate professor post for me.....and I was suppose to be at grade pay of 8000 for three years
they were direct recruits....on later appointment as associate professor......
