US company,who registered their trademark and patent in USA and not in INDIA can license their rights to Indian company as "registered user"

yes they are very much capable of licensing the said trade mark or sth to an indian co.

Hi

CO. having its Trade Mark Reg. in US can very well license the same to an Indian Co. Whereas, in case of Patent, if US co. has no Patent registration in India or has not filed any application for registration of Paten in India then it cannot license its patent rights to an Indian co.

There is no requirement to registered a trade mark, whereas, in case of patent, it is mandatory. Hope this suffice your requirement.

I agree with Ansuman.

The US company have to register the TM to use this in India
