Is FIR a warrent for arrest

(Querist) 25 March 2014 This query is : Resolved
Hi there

My brother has been invovled in fraud and a FIR has been issued for fraud and under the penal codes 420, 467 and 468 it was issued. He ran of to anoher country and has been there almost 7 months and now is going to return as his visa runs out for that country.

Does the FIR issued allow the police to arrest him as soom as he arives at the airport, or does the police need to get a court order first allowing the police to arrest him?

What is the true meaning of the FIR and exactly what powers does it have?
Devajyoti Barman (Expert) 25 March 2014
If Look Out or Red Corner notice is issued then he is likely to be arrested in airport.
If he is lucky then he should immediately apply for bail to avoid arrest on future date.

What is ment by if look out or red corner notice? Please explain thank you
Sudhir Kumar, Advocate (Expert) 26 March 2014
you have not stated since when the FIR is pending. If red corner notice is issued then he is least likely to come out of airport without being arrested unless AB is there as suggested by Mr Burman.

Even if there is no red corner notice still the police has liberty to arrest anyone accused of cognizable offence without court order, as and when found, particularly if they have reasons to argue that the accused was desperado abroad.

Agree with the expert, he can be arrested if no anticipatory bail taken.
ajay sethi (Expert) 26 March 2014
apply for AB .since he has absconded for 7 months cops must have issued red corner notice
yusuf (Querist) 26 March 2014
FIR was issued around July 2013
yusuf (Querist) 26 March 2014
Important to note FIR was issued after he absconded abroad

What is your concern with this, you have been asking too many queries on different subjects here. In your previous query you have asked about distribution of your father's property to your half brothers.
In this case, expert Mr. Sudhir Kumar's opinion and advise seems to be perfect and I agree with him.
yusuf (Querist) 27 March 2014
You give advice so i ask for advice dear advocate t kalaiselvan.

I was only informing of facts as asked in the feed. No more no less

As for to many questions only 2 on diffrent subjects. Am sure a person of your distinction is able to answer more than this many questions.
