sir,
there is a partition suit filed by my friends father and its been he got an exparte decree in his favor and know he wants to file an ep.. my question to u is after my friends father gets the final decree is it compulsory for him to get his share registered at registration office..
if yes should he go for a sale deed or any other deed.
kindly suggest me what should my friend and his father should do.

Partition suit final decree is passed by the court for that parties have to pay court fee on market value of the property then the Judgement and decree certified copy will be issued to the Parties to the partition suit or Parties to the partition suit may with the leave of the court register partition Deed in the Concern Sub-Registrar office paying stamp duty, registration fee on the market value of the Property. When did the plaintiff got final decree? Was there any appeal against the judgment/ order? If yes, wait for its outcome. If no, then get it (judgment/order/decree) registered with Sub-Registrar after payment of stamp duty as applicable in your state.
