Is the title of the flat valid ?

Dear Sir,
My father invested in 2 flats,one in his name and another in my elder brothers name in the year 1960.The agreement and the share certificate is in my brothers name right from the beginning although my father paid the money at that time.My father is not alive today and there is no will left by him.My brother wants to sell the flat now.My question is does the mother,other brothers & sisters have a share in the sale of the flat,as the money was paid by my father.Is the title of the flat valid and rightfull only for my brother?

Dear Querist,
If your father's intention was to, purchase the flat in your brother (who is invariably a coparcenor in the joint family) brother's name for the benefit of hte entire family, then you all can claim a part filing a suit for partition.
