Is transfer required- father(deceased)to son for pagadi flat

Dear Sir,
I lost my father a few years ago in whose name the Pagadi flat was, in which we are living. The flat may now go into redevelopment as per a notice sent by the BMC. I do not have any legal heirs in terms of siblings and its just me and my mom. I also do not own any other flat in my name.
Does the right to ownership transfer automatically after death either to my mother and me or do we have to get a formal transfer done through the landlord who may ask a sizeable sum, with is my contention. Worse case refuse transfer.
Also what is the course of action incase the owner refuses transfer into our name?
