Issuance of confirmation letter after probation period

Sir,
Am working in an organisation as Manager. I have joined the organisation on 12 January 2010. My confirmtion was for two years. As such my probation period has to be over by 11 January 2012. Unfortunately my organisation called for a strike on 23 January 2012. I have participated in the strike since my probation period was over. All over India in different branches about 50 candidates were joined in my batch and all my friends got their confirmation letter except me due to delay in processing my confirmation at my branch level. Now my organisation at Head Office level has defered my confirmtion since i have participated in the strike before obtaining confirmation letter. Kindly guide me what can i do in this situation so as to get my confirmation letter.

I think your management is trying to make you a scape goat to teach a lesson to the striking employees.They must be taking advantage of your probation period.

Dear Ajay,
Discrimination is clearly evident. When probation period is already over, confirmation should be with effect from the date following expiry date of probation. Event of strike happening after expiry of probation has no direct concern with the confirmation that has become due from the date earlier than the date of strike. The management can tackle the issue of strike in general and collective manner, as it is not a single case of yours.
You need to formally represent appropriately at first to the management for strengthening your base before making the issue for a legal battle. Systematic action is sure to lead you towards success.

Sir,
Thanks a lot for the ready responses. I just want to clarify that among 50 candidates joined in my batch all got their confirmation letters. Am the only person left over due to delay in processing my confirmation at my branch level. Because of this i have been now considering along with my junior batches and actions are going to be initiating. None of my batchmates are facing this issue since they are already got thier confirmation letters. In this case what can i do?

I have already mentioned, it is a clear case of discrimination. So, as a proof for such discrimination, better get response in writing about the reason for skipping of your name for confirmation.

Dear Mr.Ajay,
The other 49 got their confirmation because they have not participated in the strike.You should have consulted all your batch mates before joining the strike.In probation period you are not supposed to act contrary to the service rules and regulations.As a probationer you can't fight legally also.

Sir,
Thanks for the replies again sirs. For your kind information, all 50 of us had participated in the strike. For all of them their respective branches had already issued their confirmation letter within two weeks from the expiry date of probation. Before participating in the strike i had already contacted my branch and they gave me an assurance that if i participated in the strike also it will not affect my confirmation in any away. In this case what can i do sirs?

I just want to add that within two days not two weeks my batchmates got their confitrmation letter. Further in my case, my branch even gave me an assurance that they will be issuing my confirmation letter without any further delay. But they didnt..

Your question and clarifications were enough to understand. So, you did not need to add anything more, as you added in your latest post. You just need to be practical rather than discussing the things theoretically. Your case is quite strong to make you win on the basis of evidence in hand.
