Issues with collector permission

Hi,

I belong to Bhubaneswar, Orissa. I have made a advance to purchase a land which belong to SC community. We did a bond sign that if they can give us the collector permission, we will take the land. Now, the file has been processed by both RI and Tehsildar. The file is now with Collector. The land was handed over to them on 1972 and the land has been mutated and Pata already done. The collector is telling that the land was handed over to them in Lease, so, he can't give the permission to sell. Please advice me if the collector has the power to give the permission to sale the land. Or any alternatives. The family owners of the land owner are into private service and they have lands. Please help.

the seller is only a lessee not an owner of the land . GOVt has given to them land on lease only . hence collector has rightly refused them permission to sell the land . take your refund .

Thanks for your reply. But I am confused here that when this is a lease land, why govt give them "Pata" after mutation. The land shouldn't have been mutated at all. Because they have used that land for more than 20 years, thats why they got the land permanently in 1992(lease signed on 1972). Till now, they are also paying all the taxes and all. At the same time, RI and Tehsildar also have processed the file without any issues. Please clarify.

Generally the land of SC can be sold to only SC so the authorities might be denying to provide the desired relief.
