JOINING AFTER RESIGNATION

Sir,
I joined in The West Bengal Civil Service in 2003 as Revenue Officer in Land and Land Reforms Department (L&LR)and continued it till February 2008. During this time, having I appeared in the WBCS exam again for a higher post with prper approval from the authoiry and stood first in the West Bengal Police Service (WBPS) and stood 2nd in the West Bengal Civil Service (both are same exam, but lists are separate). I joined WBPS in Feb 2008 on LIEN from L&LR dept. But due to medical grounds, I tendered technical resignation which was accepted and joined my L&LR dept. again. In the In 2009, i again appeared in Kolkata Municipal Corporation exam. and stood first there and joined KMC again on LIEN from L&LR deptt. I am still conctinuing my service.
My question is, am i eligible for joining the Police Service again? Would you please kind enough to explain in details?

Dear Anonymous,
With your sufficiently good experience at Officer cadre, it should be clear to you that once you have resigned the service, you cannot rejoin the same service, unless again you clear the exam and get back.

Your perseverance to pursue your goal is really praise worthy.
The thing is if your resignation properly tendered and duly accepted by the concerned department then that particular assignment has come to an end.
Now in all probability the vacancy created by you is filled up and thereafter any subsequent application for the same post would depend upon the discretion of the government.

I am not conversant with the civil service rules you are governed under. Yet almost all the state civil service rules are in same line with Central Civil service rules and basic conditions are same.
1. Your lien in L & LR is saved till you are confirmed in any other post in other department. Even with your consent the lien in the L & LR dept can not be raised unless you are confirmed by the other department.
2. You never had any lien whatsoever in WBPS since before your probationary period being declared i.e., before confirmation in the WBPS, you came back to L & LR where your lien was still there.
3. Had you been confirmed in WBPS your lien in L & LR would have automatically been extinguished even without there being an order to that effect,
4. Then even if you tendered resignation on whatever the grounds, it would not be a resignation of public service but resignation to a particular post. Then if you had applied to revert to WBPS before the declaration of the probationary period,where your lien was protected, you would have been permitted to come back.
5. Under these circumstances, you can not go back to the old post on which you never had a lien.
6. You can come back to WBPS under normal rules of recruitment afresh provided you re within the age limit.

Dear Anonymous,
I appreciate the replies of S/Shri Ramachandran and Devajyoti, who have provided you to the point reply to your query.
In short, on resignation an employee severes total relations from his employer and his cadre.
So, if re-entry in the cadre is desired, a fresh attempt would be necessary, if eligible by eligibility conditions, including age.

Once you tendered your resignation and after its acceptance. You have no relation with the organisation. If you want to join services in that particular organisation, you have go through again in the recruitment process.
